Case relates to investments in Gold Quest International Pvt LtdNew Delhi: The Supreme Court has appointed Justice K.P. Sivasubramaniam, retired Madras High Court Judge as Settlement Commissioner to receive claims from lakhs of depositors who had invested in Gold Quest International Pvt Ltd under the money circulation scheme. (MCS)A Bench of Justice P. Sathasivam and Justice H.L. Dattu passed this order on an appeal filed by the State police against a Madras High Court judgment. It was submitted that the company had illegally collected Rs. 321,06,07,850 from 1,07,999 members across the State under the MCS and the police received 32,011 complaints for recovery of their money from the company. The State had registered a case and even as it was pending the High Court had directed the trial court to compound the offences insofar as they were concerned.Disposing of the appeal, the Bench said that to resolve the entire issue and to avoid unnecessary inconvenience to the complainants/persons who invested money with the company, it was submitted that a former judge could be appointed to go into the entire issue.The Bench said “taking note of the fair submission made by all counsel and also the fact that lakhs of persons and crores of amount involved in MCS under the guise of Multilevel Marketing, we appoint Justice Sivasubramaniam, as Settlement commissioner.”The Bench said the complainants/victims would be permitted to file their claims on or before May 31, 2010 for which the Settlement Commissioner could make an announcement in local dailies. http://www.hindu.com/2010/04/22/stories/2010042262960900.htm
CHENNAI: The police have seized properties valued at Rs. 47 crore, including cars and gold coins, from multi-level marketing Quest Net. This is in addition to the over Rs.3 crore worth of properties seized sometime ago. Managing director of the company Pushpam Appala Naidu, who was arrested on May 2, has been detained under Goondas Act. Efforts are on to arrest Vijay Eswaran, the group managing director, who is abroad, Police Commissioner Nanchil G.Kumaran told mediapersons here on Saturday. The seized properties included two luxury cars, 12 laptops, 87 kg of gold coins, 910 kg of silver coins, 8,372 gold watches, besides Rs.3.51 crore in cash. Frozen
Bank lockers having cash and fixed deposits in various banks, totalling Rs.50 crore, have also been frozen. Efforts are on to take possession of a building each in Hyderabad and Mumbai, valued at Rs. 32 crore, belonging to the company, besides documents pertaining to its investments in shares and mutual fund, to the extent of around Rs.200 crore.
